In the matter of the Boundaries of Opana Uka, A Portion of the Ahupuaa of Opana, in the District of Hamakualoa, Maui. Territory of Hawaii.

Commissioner: As Commissioner of Boundaries I will now proceed with the hearing on the Application of the Maui Agricultural Company, Limited, for settlement and certification of the boundaries of the land of Opana-uka, being a portion of the Ahupuaa of Opana-uka [sic], in the District of Hamakualoa, Island of Maui

The Commissioner wished to state that, in so far as the preliminary proceedings heretofore had this morning [Halehaku], and now applicable, they will be considered as constitution part of the record in this particular application. That is, the appoint of Mrs. Sinclair, as stenographer, and Mr. Lyons, as interpreter, and the interpretations heretofore made by Mr. Lyons to those present who may have an interest in this matter.

Mr. Warren: I would like to make this statement as a matter of record. The Apana was originally granted, by name only, that is, awarded by name only, and was several times conveyed by the awardee and successive grantees, by name only, without any surveys having been made until 1877. Application for certification of boundaries of the Ahupuaa of Opana was filed before the then Boundary Commissioner and boundary certificate No. 32, was issued June 6th, 1877, apparently intending to cover Opana with a stated area of 1468 acres. The testimony taken at that hearing, as that record will show, was more or less meagre [sic], because at that early day very few individuals were acquainted with the extreme mauka lands. In fact very few are now. In that connection I want to offer evidence at this time.

This section for which this application has been made has been very carefully gone over into between the Surveyors for the Petitioner and the Surveyors of the Territory; it has been recognized by the Territory that the land of Opana includes the mauka land, and the Territory has no interest in the land, and concedes that fact. There is evidence and I wish to offer that, and the references to other lands adjoining being bounded by Opana-uka. I may suggest that it would be very logical to assume that if this piece of land of Opana-uka were any portion of Opana then it would be government land. In this connection I offer also a separate letter written by W.A. Wall, Surveyor for the Territory, to C.T. Bailey, Commissioner of Public Lands, dated May 5th, 1924, indicating that he had checked, and is satisfied that the boundaries claimed, and that the Territory claims no interest in this land.

6. Thence along the Ahupuaa of Peahi, Grants 149 and 221 to H.S. Swinton, along the center line of Opana Stream, the direct azimuth and distance being: 356° 51' 269.1 feet to a point of said center line.

Thence along same continuing along center line of Opana Stream, the direct azimuth and distance being: 330° 34' 37” 7581.0 feet to a chiseled cross, the center of which is a drilled hole filled with lead, in rock bed of said stream, said cross being 10 feet East of center line of stream at lowest flows, 23 feet makai of junction of small gully from East with main stream and 58 feet mauka of prominent waterfall and being also described as the Southwest corner of the Ahupuaa of Peahi, Grants 149 and 221 to H.S. Swinton;
9. 129° 28' 08” 5063.4 feet along Haiku-uka, Grant 182 to Kekuanaoa (guardian for V. Kamamalu) through eucalyptus forest to a 2 inch pipe (type “A”, E.M.I. Co. monument) at the Southeast corner of the Ahupuaa of Kaupakalua, Hikina, Grant 771 to Hikiau; said pipe having the true azimuth and distance 278° 00' 594.0 feet from a second 2 inch pipe (type “A” E.M.I. Co. monument) which marks the Southwest corner of said Ahupuaa of Kaupakalua Hikina at the end of Kaiwiohole Ravine;
Note: This course across the mauka end of Kaupakalua Hikina corresponds to course 53 of description included in Grant 771 to Hikiau.
10.154° 21' 04” 3342.7 feet along the Ahupuaa of Kaupakalua Hikina, Grant 771 to Hikiau, along Kula and crossing gulch to a 2 inch pipe (type “A” E.M.I. Co. monument), said pipe having the true azimuth and distance: 278° 00' 594.0 feet from a second 2 inch pipe (type “A” E.M.I. Co. monument); said second pipe being by resurvey, the “Post marked G, above a deep ravine “Kaiwiohole” referred to as the end of course 26 of the description included in Grant 182 to Kekuanaoa.
11. 170° 12' 12” 3368.7 feet along same to the point of beginning, the true azimuth and distance to said point being: 188° 57' 90.0 feet.
Note: Courses 10 and 11 of this description correspond to course[s] 51 and 52 of the description included in Grant 771 to Hikiau, the Ahupuaa of Kaupakalua Hikina.
Containing an area of 342.0 Acres.
