The undersigned would respectfully request your Honor to set a day for the hearing & settling of the boundaries of the land of Kalaoa situated in the district of Hilo, Island of Hawaii, as per survey or otherwise, as shall be set forth on the day of hearing; and that having heard Your Honor will give a certificate of the same.
And as in duty bound your Petitioner will ever Pray, &c, J.M. Smith

Land of Kalaoa
On this the 18th day of October A.D. 1877, the Commission of Land Boundaries for the island of Hawaii 3d Judicial Circuit, met at the house of F.S. Lyman, in Hilo, Hawaii, on the application of J.M. Smith per E.G. Hitchcock, attorney, filed August 22, 1873 and recorded in Book 1 or A folio 249, for the settlement of the boundaries of portions of the land of Kalaoa, District of Hilo, Island of Hawaii, 3d Judicial Circuit.

The Commission met without notice to interested parties to take the evidence of F.S. Lyman in relation to the surveys of diffrent [sic] portions of the land, filed by him this day, as he is expecting to go to Honolulu today to be absent several weeks.

F.S. Lyman, sworn, says, the people owning Kalaoa employed me to survey the land, and divide it up for them during the years 1875 & 1876. I divided the land between them, and made survey of the diffrent portions, taking the natural boundaries, a ravine on North side from shore to edge of woods be ....

.... ndeavored to obtain all information possible to enable me to arrive at a just decision, which will more fully appear by reference to the records of this matter by me kept in Book No. 2 (B), pages [sic]433, and it appearing to my satisfaction that the true, lawful and equitable boundaries, are as follows, viz.;

Hema 67½° Komohana 18.53 kaulahao a hiki i kahi i hoomaka ai. Maloko o keia apana aina 37 3/4 Eka a oi iki, a emi iki paha.

It is therefore adjudged and I do hereby decide and certify that the boundaries of the said land are and hereafter shall be as hereinbefore set forth.
