The Ahupuaa of Malamalamaike, District of Hilo, Island of Hawaii, 3d Judicial Circuit

On this the 30th day of June A.D. 1874 the Commissioner of Boundaries for the Island of Hawaii, 3d Judicial Circuit met at the court House at Hilo, Hawaii, on the application of L. McCully, Attorney at Law for Noa Kaikinui, for the settlement of the boundaries of the Ahupuaa of Malamalamaike, situated in the District of Hilo, Island of Hawaii. Notice personally served on D. Kamai, Agent for Hawaiian Government.

Notes of survey filed by P. Ama, on May 1st 1874 presented by applicant.

Ama took Oath May 1st as to said Notes of survey.
He said, I am a land surveyor and I surveyed this land as Kauena pointed out the boundaries to me, and copied Notes of survey from Patents of adjoining lands; from the Kaupakuea hawai. I surveyed up the road to Ohiakiikii and not on the boundary, but surveyed across to boundary at flume.

Testimony
Kauena, kane, sworn (about 70 years old), I was born at Mahlamalamaike during the reign of Kamehameha I and have always lived there, and my forefathers before me. I was large enough to go about at the time of the battle of Kuamoo; know the boundary of the land as it is a small one, and a trail is the boundary between the two Malamalamaike. Know Ama and pointed out the boundaries between the two ands to him.

He surveyed the one adjoining Honomu gulch and he surveyed it as I pointed it out.

He commenced at the mauka corner at Ohiakiikii, a resting place on the road in the woods. He then surveyed down the road to Hawai of Kaupakuea, not on the boundary. Thence towards Hamakua to where I pointed out the boundary between the [page 284] two lands; Thence to Naomi's land on Malamalamaiki 1. He surveyed as I told him without disputing the boundary. From the mauka corner of Naomi's land to the shore the adjoining land has been sold. We went to shore and surveyed across from corner of land sold to Honomu gulch.

The Honomu gulch is on the Hamakua side of this land and is the boundary from shore to opposite Ohiakiikii, where Malamalamaike is cut off by Honomu. Bounded makai by the sea.
Cross-examined

Kaiakoili, kane, sworn, I went and carried the chain with Nawai when Ama surveyed the land. Kauena was the kamaaina. Commenced at Ohiakiikii and surveyed across the land to Honomu gulch. Marked a tree at road to flume. We then went down to where we came to the gulch and surveyed from there across to Honomu gulch. Then went to Palau's house and surveyed to shore, and then across to the Honomu gulch. We went where Kauena pointed out.
Cross-examined.

Nawai, kane, sworn, I went with Kauena and Kaiakoili when Ama surveyed the land. My knowledge is the same as the last witness has testified to.

55. North 79° 08' West true 1048 feet around the sea bluff to the Initial point. The boundary being the high water mark along the sea to the mouth of the Honomu Stream.
And containing an area of 328.82 acres

It is therefore adjudged and I do hereby decide and Certify that the boundaries of the said land are, and hereafter shall be as hereinbefore set forth.
