On this, the 13th day of April A.D. 1876, the Commission of Land Boundaries for the Island of Hawaii, 3d Judicial Circuit, met at the Court House at Hilo, Hawaii, on the application of J.O. Dominis, Crown Land Agent by F.H. Harris, Attorney at Law, for the settlement of the boundaries of the Ili Aina Waiakoloa, ili of Kalapana, situated in the District of Puna, Island of Hawaii, 3d Judicial Circuit.

Notice of time and place of hearing personally served on interested parties, as far as known.

Present: L. Kaina for applicant, and the Hawaiian Government

J.M. Lydgate filed a map and notes of survey of this land before he went to America & said he surveyed as pointed out. Several witnesses were subpoena to appear on the first of March, but were not examined as they knew nothing about the survey, or the boundaries of the different portions of the land. They were paid for coming in and discharged.

Testimony
Puahau, kane, sworn, says (quite an old looking man), I was born at Kalapana, Puna, Hawaii at time of Kamehameha I going to see Kumualii at Oahu. I have alway[s] lived at Kalapana, and know the land of Waiakolea; it is an ili kupono of Kalapana. I am a kamaaina of the land, and know its boundaries. Waiakolea is an aina lele. Three pieces that I know about (ekolu apana ua hoomapopo ia) and other lele mauka loa, aole hoomapopoia. I know the apana at the sea shore. It is bounded makai by the sea. Mi's land Patented, lays on north side of it, Kanakaole's land Patented on the south side, Kaaihili's[,] Ili's and Kaiwi's lands all patented on the mauka side of it. The ancient fishing rights extended a short distance out to sea. If the men swam in the sea with the upena ku, then the fish belonged to this land, but if they went in canoes to fish, then the fish belonged to Kalapana, as the landing place ....
