1873 Boundary of the Ahupuaa of Kikiaola, Waimea, May 8th 1873

Honorable D. McBryde, Dear Sir:
I hereby beg to request that you will, when convenient, have the boundaries of the following lands settled and defined.

The Ahupuaa of Koloa bounded East by Mahaulepu and Haiku belonging to the Estate of Kamehameha V, North by Kamooloa and Kalaheo, West by Lawai and South by the sea.

The Ahupuaa of Kikiaola bounded East by the Ahupuaa of Waimea, North by Waimea and Pokii, West by Kekaha and South by the sea.

Therefore appointed the 15 day of April A.D. 1874 for thee hearing of said petition at Waimea Court House at the hour of ten a.m.

Komo, sworn, I was born at Kikiaola my kuleana is there, and went the Chiefs as a body man also my brother, all dead that know boundary. The boundary commences at a stone in the river called Pohakalani; thence down auwai of Kikiaola to Waiuli; thence along pali below house of Eleelekai and east side of Nawaheau?s house. Thence down to stones near rice house and out to reef and thence west along to a little sand hill called Kikiai and thence north to the pali Huluhulunui and thence along foot of pali to a large stone called Poakalani [sic],the place of commencement. Makemake, sworn: Commencing at Waiuli and thence along water lead of Kikiaola to promontory or Lae of Kikiaola; thence along pali by Kuapuu house, There are also three kalo patches in valley called Kahiamoa. The Kula land commences at a rocky point called Kaaimanumanu and thence South along pali to Papaenaena and thence to rolling surf on reef and thence to a place in sea, Kuhiki, and thence along to opposite lie [lae] of Kihiai in the pali of Huluhulunui and thence including face of pali to place of commencement.
Cross-examined
I know this from my father. He had Luhi, it belonged to him, he had the fishing right also the [to] Kula.

Kahoolealii, sworn, Commences at Pohakalani, thence down to Waiuli and thence between Waiuli and Kaainioi to the Auwai of Kikiaola and thence along the auwai to the pali and thence round to Pohakulani, the place of commencement. The Boundary runs along the pali to Papaenaena and out to ....

.... is there still. This auwai comes down to a place called Paele, disputed land about 20 fathoms in width, never heard of any Kula land belonging to the Kikiaola, except the patch of Pale, sea given by Kaumualii to a person because there was no fishing right attached to this land.

Cross-examined.
Knew Whitney never knew this land to belong to him, nor have heard that sea belonged to Whitney, don't know name of this Kula. After death of Whitney, don't know to whom sea belonged perhaps to Whitney's wife or her heirs. Don't know if sea was kapued. Nahauaia was formerly konohiki, this sea was then kapued.

Kaumiloli, sworn, I lived in Kikiaola from the time of Kaikeoewa. The boundary is at an old watercourse made to take water into Paele. Kikiaola commences at Pohakahalani form Pali to auwai belongs to Waimea, don't know of any Kula land belonging to Kikiaola. This kula land in dispute belongs to Waimea. Top of pali belongs to Hulumanui and to the sea. Kaumualii gave the sea to Whitney, or a loi, the Kula land, sea was given to the kalo lands of Kikiaola.
Presented several documents in this disputed land and described as in Waimea.

Decision
The Commissioner finds for the petitioner in regard to the disputed land between the old auwai and the pali; said land belongs to Kikaola. The commissioner also finds that the Kula land surrounding Mr. Rowell's land and the church land belongs to Kikiaola with the fishing right pertaining to the same.

The Boundary of this land commences at a stone called Pohakalani and from there to the Pali (including three kalo patches); Thence the Boundary follows the top of the pali down to the lae of Kapapaenaena near Mr. Knudsen's rice house; Thence out to sea at edge of reefat a place called Kuakelii; Thence along the reef to a place opposite to Kikiai; Thence mauka to a stone at foot of pali and thence along the face of pali to place of commencement.

Notes of survey, Kikiaola for the Certificate from which a patent may be issued, encroaches and includes kuleanas duly awarded and located in another Ili (See section 354) R.P. 1905
