Proceedings

In the Matter of the Settlement of the Boundaries of the Ili of Waialae nui, Kona, Oahu, Territory of Hawaii

July 6, 1927, an application was filed by William O, Smith, E. Faxon Bishop, A.F. Judd, William Williamson and Richard H. Trent, Trustees under the Will and of the Estate of Bernice P. Bishop, deceased, through their attorneys, Robertson and Castle, setting forth that the Ili of Waialae nui, District of Kona, Oahu, was awarded to Victoria Kamamalu as Apana No. 50 of Land Commission Award 7713 by name only and not by survey; that the petitioners as successors in title and interest to said Victoria Kamamalu claim to be the owners of the said Ili of Waialae nui, the outer boundaries of which have not been settled, determined or certified, and praying that said boundaries be settled, determined and certified to be as follows:

Part 1
Beginning at a point known as “Lae o Kupikipikio” at a ½ inch pipe in concrete on the seashore at the South corner of this lot, the coordinates of said point of beginning referred to Government Survey Triangulation Station “Leahi” being 1649.5 feet South and 6861.3 feet East, and running thence by true azimuths as follows:

1. 156° 55' 753.9 feet along land of Kapahulu to U.S. M.R. Monument #1;
2. 190° 19' 6,544.0 feet along land of Kapahulu to a ¼ inch pipe in concrete on easterly side of stonewall;
3. 190° 08' 870.0 feet along land of Kapahulu; thence along old foot path along land of Waialae-iki to the middle of Kapakahi stream, the direct azimuth and distance being;
4. 279° 10' 2,370.0 feet; thence along Kapakahi stream along land of Waialae-iki; the direct azimuth and distance being;
5. 323° 00' 748.0 feet;
6. 230° 55' 376.0 feet along land at Waialae-iki;
7. 317° 18' 268.0 feet along same;
8. 55° 28' 663.0 feet along same to the Kapakahi stream; thence along Kapakahi stream along Waialae-iki, the direct azimuth and distance being;

These amendments being made at the request of the Territorial Surveyor.

William H. Smith, sworn, testified as follows, I was and have been a surveyor in the employ of the applicants for some years. I am familiar with the boundaries of the lands of Waialae nui and Waiale iki (shown map accompanying the application). This map was prepared in the office of the applicants under my supervision. (Map offered and received in evidence). The first course of Part I follows the boundary of the land of Kapahulu as already determined by boundary certificate. The second and third courses of Part I and the first course of Part 2 follow the boundary of Kapahulu as determined by the same boundary certificate (A certified copy of the boundary certificate No. 81, Ili aina of Kapahulu, apana 1, offered and received in evidence). The first course of part 2 was extended to a point called “Kalepeamoa.” From that point the boundary follows the top of the ridge between Palolo and Waialae nui Valleys to the top of the Koolau Ridge, along the Palolo Homestead Grants, the description coincides with the survey of each grant. The next courses follow the top of the Koolau Range. The remaining courses follow the boundary of Waialae iki as already determined by boundary Certificate. The boundaries of Parts 3 and 4 also conform to the boundary certificate of Waialae iki, which is now owned by the applicants. There are a number of kuleanas scattered in and about Parts 3 and 4. [page 65]

Mr.Greenwell asking whether the owners of these kuleanas should not have been notified of the hearing, the Commissioner ruled that as the boundaries and ownership of these kuleanas was in no ways affected by the location of the boundaries of the konohiki land that it was not necessary to show them on the map or to notify the owners of them; that adjoining land as stated in the law meant so-called “konohiki land” only.

The Commissioner rendered the following decisions:

Decision
I hereby find and decide the true and lawful boundaries of the Ili of Waialae nui, Kona, Oahu, Territory of Hawaii, to be as set forth in the application for settlement of boundaries filed with me by the Trustees under the Will and of the Estate of Bernice P. Bishop, on July l6, 1927, as amended by the striking out of the world “South” in the 4th line of the description of Part 2 and the substitution therefor of the word “North.”
