To the President of the Land Commissioners and the other four Commissioners appointed to quiet titles of the Hawaiian Islands: As in the new law enacted in 1845, and since I, the undersigned have a claim on the Island of Oahu, Hawaiian Islands, mauka of Honolulu on the road climbing straight up, just mauka of the back of Pahu's place, thence going to the place called Kawelo. Above there is my place for which I petition you, the commissioners, for my house lot there. The total circumference of the lot is 120 fathoms, 2' 9". The basis of my interest was Pehu. It was he who appointed me as kahu of this house lot. Because of the real truth of the interest in this house lot, therefore I petition you, the people who remove entanglements.

Iona Kapena, sworn by the Word of God and stated, "I had seen before I had gone to Lahainaluna, an idle land which was for Pehu who was the konohiki. Maiao was living there when I had returned from Lahainaluna. He had received this interest from Pehu and had built a house. He died in 1845 in Ewa and I have not known his heir. Maiao had enclosed the lot and upon his death I have not known of a bequest made for Pehu. Kapu has an interest under Pehu, perhaps it is equal to Maiao's interest and subject to Pehu; however that property has been turned over to Ke-kualoa and Kapu is the aide. The only house there is the one Maiao had built. Kapu did not build a house for himself there."
